Please read these Terms of Use (the “Terms”) carefully.
By agreeing to rent a motorcycle from TY Bikes SARL, you accept and agree to be bound by these Terms. These Terms constitute a binding contract between you and us as soon as you rent a motorcycle from us.
We reserve the right, at our sole discretion, to modify, alter, or update these Terms at any time. These changes will take effect immediately upon posting on our website.
Unless otherwise specified, the terms “we,” “our,” and “us” refer to TY Bikes. The terms “User,” “you,” or “your” refer to the person(s) entering into the rental agreement with us. The term “motorcycle” refers to the rented motorcycle.
1. RENTAL TERMS
1.1 Vehicle Condition
Each motorcycle is delivered in a clean condition, appropriate to its age, size, and type. You accept full responsibility for your choice of motorcycle.
1.2 Rental Duration
The rental duration and period are specified in the rental contract. Canceling a reservation may result in the loss of any amounts paid for the reservation.
1.3 Ownership
The motorcycle remains the exclusive property of TY Bikes SARL at all times. No ownership rights are transferred to you under any circumstances.
1.4 License Requirements
You must hold a valid motorcycle license for driving in Morocco. Foreign drivers must also present a passport. We recommend clients obtain comprehensive medical insurance (coverage for assistance, medical expenses, and repatriation) in their home country.
1.5 Refusal of Rental
We reserve the right to deny rental if we believe the driver lacks the appropriate license or the skills to operate the motorcycle safely. Note : A motorcycle test may be required before taking possession of the bike.
1.6 Prohibited Use
Driving on beaches, grasslands, through rivers, floodwaters, or any body of water is strictly prohibited.
1.7 Client Responsibility
TY Bikes SARL is not liable for any inaccuracies in personal information provided by the client (e.g., email, phone number).
1.8 Security Deposit
The security deposit is intended to cover any damages, unpaid rental fees, or loss of the motorcycle. The deposit amount is stated in the rental contract:
- Any or all of the deposit may be retained for damages to the motorcycle or accessories.
- If the motorcycle is not returned, the full deposit will be withheld.
- In case of no damage or theft, the deposit will be refunded within 15 days after the rental period ends.
The deposit must be paid by credit card. Cash, checks, or debit cards (e.g., Maestro, Electron) are not accepted.
2. DAMAGES/ACCIDENTS
2.1 Included Insurance
Your rental includes third-party liability insurance as per legal requirements. Additional insurance coverage provided includes:
- Roadside Assistance
- Theft/Fire Coverage
- Comprehensive Damage Coverage (10% deductible)
However, it is recommended to have additional insurance for personal injuries or repatriation.
2.2 Responsibility for Damages
If damages occur due to misuse or a violation of these Terms, you are responsible for all repair costs, replacement parts, and recovery expenses.
2.3 In Case of an Accident
- Obtain details of all parties involved (name, address, license, insurance details).
- Provide full cooperation, including statements or documentation.
- Inform the police if legally required.
- Do not admit liability to any party.
- Fill out and return an accident report provided by TY Bikes Agency.
2.4 Damage Liability
You are responsible for :
- Damage or loss of the motorcycle.
- Damage to third-party property caused by you or an authorized driver.
- Costs associated with water damage, negligence, or reckless use of the motorcycle.
3. CANCELLATIONS
3.1 By TY Bikes
In cases of force majeure (e.g., vehicle unavailability due to accidents or prior rentals), we will offer a replacement vehicle or a full refund of the deposit.
3.2 By the Renter
- Basic Package:
- Cancellations 90+ days before the rental: 100% refund.
- Cancellations 30–90 days before: 50% refund.
- Cancellations within 30 days or no-shows: No refund.
- Comfort Package:
- Cancellations up to 48 hours before the rental: Full refund.
4. LATE RETURNS
Returning the motorcycle after the agreed time without prior notice will incur:
- Up to 3 hours late: Half-day rental fee.
- More than 3 hours late: Full-day rental fee for each additional day.
5. PAYMENT TERMS
All payments are processed securely through a third-party payment system. You agree to the collection of all applicable fees, deposits, and penalties as outlined in the rental agreement.
6. LIMITATION OF LIABILITY
TY Bikes is not liable for:
- Losses or damages caused by misuse or reckless driving.
- Off-road accidents or damages outside the agreed rental terms.
- Any indirect, incidental, or consequential damages.
7. GOVERNING LAW
These Terms are governed by the laws of Morocco. Any disputes will be resolved in Moroccan courts.
